Welcome to Duck Friends. These Terms of Service ("Terms") are a binding agreement between you and Josh Ronk, an individual doing business as Duck Friends ("Duck Friends," "we," "us"), covering your use of duckfriends.com and everything on it (the "Service").
Read Sections 6 (Vet Directory), 7 (Sitter Classifieds), 9 (Not Veterinary Advice), 18 (Disclaimers), 19 (Limitation of Liability), and 21 (Disputes) carefully. They limit our liability and affect your legal rights.
1. Accepting these Terms
You accept these Terms by checking the box when you create an account. If you browse without an account, you accept them by using the Service.
We may change these Terms. If a change is material, we will post a notice on the Service and update the "Last updated" date at least 14 days before it takes effect, and — if you have an account with a verified email — email you. Continuing to use the Service after a change takes effect means you accept the new Terms. If you don't accept them, stop using the Service and delete your account.
2. Who may use the Service
You must be 13 or older to use the Service and to create an account. The Service is not directed to children under 13 and we do not knowingly collect personal information from them. If we learn that an account belongs to someone under 13, we will delete it and its data. If you are a parent or guardian and believe your child under 13 has an account, contact us at [email protected] and we will remove it.
If you are between 13 and 18, you may use the Service only with the involvement of a parent or guardian, and only they may agree to these Terms on your behalf.
The Service is operated from the United States and intended for US users. If you use it from elsewhere, you do so on your own initiative and are responsible for compliance with your local law.
3. Your account
One account per person. Use accurate information, keep your password secret, and tell us promptly at [email protected] if you think someone else is using your account. You are responsible for activity under your account.
You may delete your account at any time from your account settings. See Section 17 for what happens to your content when you do.
4. Your content
You keep ownership of everything you post — forum posts and replies, duck profiles and photos, sitter listings, cause submissions, community stories, messages, and anything else you submit ("Your Content").
You grant Duck Friends a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, adapt for display, publish, and distribute Your Content on and in connection with the Service — including in search-engine results, in social previews, and in a reasonable amount of promotional material about the Service itself. This license exists so we can run the site; it ends when you delete the content, except for (a) copies retained in backups for a reasonable period, (b) content others have re-shared or quoted within the Service, and (c) content we must retain under Section 17 for moderation and legal records.
By posting Your Content, you represent that:
- you own it or have the rights to post it;
- it does not infringe anyone's copyright, trademark, privacy, or publicity rights;
- any photograph or video you post is yours to post, and any person identifiable in it has consented;
- any factual claim you make in it is one you believe to be true and have a good-faith basis for;
- it complies with Section 5 and with the specific rules in Sections 6, 7, and 8.
We do not pre-screen most content, and we have no obligation to. We may remove, edit, refuse, or restrict any content at any time, with or without notice, at our discretion — including content that is lawful but that we judge harmful to the community. See Section 16.
4.1 Duck gifs and stills
Members may upload short video clips and still images to the duck gif gallery, add text to them, and have us convert clips into animated gifs and video files ("Gifs").
- Only upload what you have the right to share. That means footage and images you made yourself, or that you have permission to use. Do not upload clips from films, television, streaming services, music videos, or other people's social media unless you own the rights or hold a license that allows it. When you submit a Gif you confirm this by ticking the rights box, and that confirmation is stored with your submission.
- We review every Gif before it is published, and we may decline, edit the text of, or remove any Gif for any reason, including a Gif that is lawful but off-topic or not about ducks. A Gif being approved is not a statement by us that it is non-infringing or that you have the rights to it.
- How we use your Gif. The license in Section 4 applies. In particular, anyone who sees a published Gif can link to it, embed it, and share it using the share tools on its page, and we may convert it into other formats and sizes to make that work. Once a Gif has been shared or embedded elsewhere, deleting it from Duck Friends does not remove copies other people have made.
- People in your Gif. Only upload footage of people who have agreed to appear in it. If you are in a Gif you did not agree to, or you are a parent of a child shown in one, email [email protected] and we will remove it.
- Taking a Gif down. You can delete your own Gifs from My gifs at any time; we delete the stored files right away. Every Gif has a Report button, and copyright complaints follow Section 13. When we take a Gif down, we delete the public versions immediately but may keep the original upload privately for up to 30 days so that a valid counter-notice under Section 13 can be honored; after that it is deleted.
- Repeat problems. Uploading material you do not have the right to share, repeatedly, may lead to loss of upload privileges or account termination (Section 16).
5. Community Guidelines
Duck Friends is a small community about keeping pet ducks well. These rules apply everywhere on the Service, including the forum, directories, listings, and private messages.
Don't post:
- False statements of fact about a real person or business. Opinions are welcome; made-up facts are not. This matters most when you are talking about a named vet clinic — see Section 6.
- Other people's private information — home addresses, phone numbers, workplaces, or anything else that identifies a private individual, without their consent. In HOA and dispute stories specifically, do not name individual board members, property managers, or neighbors (Section 8).
- Harassment, threats, hate speech, or targeted abuse, including of vet clinics, sitters, rescues, or their staff.
- Content that infringes someone's copyright or trademark — including photographs, article text, and clinic marketing copy you did not write.
- Spam, bulk unsolicited messages, affiliate-link drops, or commercial promotion outside the directories and classifieds built for it.
- Sexual content, content sexualizing minors, or graphic violence. Frank photos of injury or illness posted to get husbandry help are fine and expected; gratuitous gore is not.
- Sales of live animals. Rehoming a duck through the community is welcome; running a hatchery sales channel through the forum is not.
- Advice or instructions that would cause obvious harm to an animal, and content promoting animal cruelty, fighting, or neglect.
- Impersonation — of another member, of a veterinarian or veterinary practice, of a rescue, or of Duck Friends staff.
- Content that violates applicable law, including state and federal rules on animal transport, reportable disease (see Section 9), and controlled or prescription-only veterinary products.
Don't do:
- Scrape, crawl, or bulk-download the Service, or use automated means to extract the vet, rescue, or charity directories. These directories were compiled by hand from public licensing records and direct outreach; republishing them is not permitted.
- Circumvent moderation — evading a suspension with a new account, or reposting removed content.
- Probe, load-test, or interfere with the Service's security or availability.
- Use the messaging system to contact members for anything other than what the Service is for.
Breaking these rules can get your content removed and your account warned, suspended, or banned (Section 16).
6. Vet directory
The vet directory is the part of this Service with the most potential to hurt someone, and it has the most rules.
6.1 What the directory is and is not
Directory listings are compiled from public state veterinary licensing records, professional association directories, and information submitted by practices themselves. A listing is not an endorsement, a recommendation, a certification, or a statement that we have verified anyone's license, insurance, credentials, competence, or experience with waterfowl. We do not verify these. Confirm a practitioner's license directly with your state veterinary board before entrusting an animal to them.
Listing information — hours, services, phone numbers, whether a clinic still sees waterfowl — may be out of date or wrong. Call the clinic.
6.2 There are no member reviews at launch
The directory does not currently accept or display member reviews of veterinary practices. If that changes, we will publish a review policy before the first review goes live, and it will say — at minimum — that reviews must be first-hand, that knowingly false statements of fact are prohibited, and that paying us for an enhanced listing will never buy removal, suppression, or reordering of a review (Section 15).
Nothing in these Terms restricts your ability to post an honest review of Duck Friends, or of any business listed on it, anywhere. Any clause purporting to do so would be void under the Consumer Review Fairness Act, 15 U.S.C. § 45b, and we are not attempting one.
6.3 Talking about practices in the forum
Members do discuss clinics in the forum, and that is allowed and useful. The Section 5 rule applies with full force: share your experience and your opinion, but do not state as fact something you know to be false or have no good-faith basis to believe.
"The vet was dismissive and I left unhappy" is an opinion about your experience. "The vet is unlicensed" or "the vet killed my duck through negligence" are statements of fact — if untrue, they can expose you to a defamation claim brought by the practice against you personally. Section 230 of the Communications Decency Act protects us from liability for what you write. It does not protect you.
6.4 If you are a practice and something here is wrong about you
We would rather fix an inaccuracy than defend one.
- For a wrong listing detail — address, phone, hours, services, whether you see waterfowl — claim your listing, or email [email protected]. We will correct it.
- For something a member posted, email [email protected] with a link, the specific statement you say is false, and why. Please distinguish statements of fact from opinions about a member's own experience — we generally will not remove the latter, and we do not remove posts merely for being unflattering.
- What we do: we look at it, may contact the member, and may remove the content, ask them to revise it, or leave it up. We aim to respond within 10 business days. Our decision is final as far as the Service is concerned.
- We have no legal obligation under Section 230 to remove third-party content, and a threat alone will not move us. Send us facts. Conversely, we are not interested in hosting a lie about your practice, and if you show us one is a lie we will act.
If a court of competent jurisdiction orders removal of specific content, we will comply with the order.
6.5 Claiming a listing
When you claim a listing you represent that you are the practice's owner or an authorized representative. We verify claims by best-effort means — by emailing a confirmation link to an address at the practice's own website domain, or, where there isn't one, by phone. Our verification is thin and you should not treat a "claimed" badge as proof of anything beyond "someone asserted control of this listing and we did not find a reason to disbelieve them." We may reject or revoke a claim at any time. Claiming a listing does not transfer ownership of the listing to you.
7. Sitter classifieds
Duck Friends is not a party to any arrangement made through the sitter classifieds. We facilitate introductions only.
Read that again, because everything else in this section follows from it.
- We do not verify identity. We do not run background checks. We do not check references, insurance, licensing, experience, or criminal history. We do not vet sitters or owners in any way. The words "sitter" and "listing" imply no screening whatsoever.
- We do not handle, hold, process, escrow, guarantee, or insure any payment. Money — if any — is between you and the other person, off-platform and outside our knowledge.
- We are not an employment agency, staffing service, pet-sitting service, broker, agent, or insurer, and no employment, agency, partnership, or joint-venture relationship is created between you and us, or between you and another member, by using the classifieds.
- Listings are posted by members, not by us. We do not endorse or recommend anyone who posts one. Listings expire automatically after 60 days.
Your responsibility. You are solely responsible for deciding who to invite into your home, who to give access to your animals, and whose animals to accept. Meet in a public place first when you can. Ask for and check references yourself. Get any arrangement — dates, duties, payment, veterinary authority, emergency contacts, what happens if an animal dies — in writing between yourselves. Consider a written pet-sitting agreement and your own insurance.
Assumption of risk and release. In-person meetings with strangers carry real risk of injury, theft, property damage, animal illness, animal death, and worse. You knowingly assume that risk. To the fullest extent permitted by law, you release Duck Friends from any claim, demand, damage, or liability of any kind — known or unknown — arising out of any interaction, arrangement, transaction, meeting, or dispute with another member that originated through the Service, including anything that happens at an in-person meeting or in anyone's home.
Reporting. Every listing has a Report button. Use it for anything that looks unsafe, fraudulent, or against Section 5, and email [email protected] for anything urgent. Reported listings go into a moderation queue where we may take the listing down, contact the poster, or ban the account. If someone is in danger or a crime has occurred, contact law enforcement — we are not an emergency service and we cannot help you in real time.
8. Community stories and HOA content
We collect and publish members' first-hand accounts of HOA, covenant, and municipal-code disputes about keeping ducks, and we publish research on municipal codes.
This is not legal advice. Nothing on the Service — not the founder's story, not another member's story, not a summary of a court case, not a municipal-code writeup — is legal advice, and reading it creates no attorney-client relationship. Every situation turns on the specific language of your covenants, your state's law, and facts we know nothing about. Talk to a lawyer licensed in your state before acting on anything you read here.
Case-law summaries on this Service are informal, incomplete, and may be out of date or wrong. Outcomes in these disputes are genuinely mixed — courts have ruled both ways on near-identical covenant language. Do not treat anything here as a prediction about your case.
If you submit a story, you agree that:
- You are describing your own experience, accurately and in good faith.
- You will not name individual private people — board members, property managers, neighbors, or employees. Refer to roles ("the board president," "our property manager"). This protects you as much as us: naming someone in an accusatory account is how a story becomes a defamation claim against its author.
- You may quote covenant, code, and correspondence language that applies to you, but you are responsible for your right to reproduce documents you did not write.
- We may edit your story for length, clarity, and the rules above, decline to publish it, or remove it later.
- Section 4's license applies. Published stories carry an explicit "this is one member's personal experience, not legal advice" framing.
9. Not veterinary advice
Duck Friends is not a veterinary practice and does not provide veterinary care. Everything on the Service — articles, forum threads, replies from other members, directory listings — is general information about keeping ducks. It is not veterinary advice, not a diagnosis, and not a treatment plan.
Using the Service does not create a veterinarian-client-patient relationship with us, with any veterinarian who may participate in the community, or with any practice listed in the directory. Under state veterinary practice law, a valid VCPR generally requires a licensed veterinarian who has physically examined your animal.
Other members are, with rare exceptions, not veterinarians. They are duck keepers sharing what worked for them. Their advice is not screened by us for accuracy or safety. If your duck is sick or injured, call a veterinarian. Never delay seeking veterinary care, or disregard advice a veterinarian has given you, because of something you read here.
Reportable disease. Avian influenza (HPAI) and certain other poultry diseases are reportable to state and federal animal-health authorities. If you have unexplained sudden deaths or illness in your flock, contact your state veterinarian or USDA APHIS — do not rely on the forum to work out what it is.
10. Rescue and charity directories
The rescue and charity directories are informational and free. A listing is not an endorsement, and we do not verify an organization's legal status, 501(c)(3) determination, licensure, finances, governance, or animal-care practices. Anyone can submit an organization for review, and our approval is editorial, not a vetting. Do your own diligence before donating or surrendering an animal — for US charities, check the IRS Tax Exempt Organization Search and a charity evaluator. We are not responsible for what any listed organization does or fails to do.
11. Articles, product recommendations, and affiliate links
Articles on the Service are written by us and reflect our own opinions and experience. They may be wrong, and they may be out of date. Prices, availability, and product specifications change.
Some links to products are affiliate links: if you buy through one, we may earn a commission at no additional cost to you. We disclose this clearly and near the link itself, per the FTC's Endorsement Guides (16 C.F.R. Part 255). A commission does not buy a recommendation — we recommend what we would use, and we say when we have not personally used something.
We are not the seller of any product linked from the Service and are not responsible for it, for the merchant, or for your transaction with them. Product recommendations for animal housing, feed, and equipment are general and may not suit your climate, flock, or setup.
12. Messages
The Service includes private messaging between members. Messages are private from other members, but they are not end-to-end encrypted and they are not private from us in every circumstance:
- We can access message content when necessary to investigate a report, enforce these Terms, respond to legal process, or protect someone's safety.
- When a sitter listing is reported, moderators can read the conversations tied to that listing. This is deliberate — it's how we assess whether a report about an arrangement is well-founded.
- Message notifications are delivered by email if you opt in. An official moderation message from us will be emailed to you regardless of your notification setting.
Don't send anything through the messaging system you would not want a moderator to read. Don't use it for spam, bulk outreach, or solicitation.
13. Copyright and DMCA
We respect copyright and we respond to valid notices under the Digital Millennium Copyright Act.
To report infringing material, send a written notice to our designated agent containing everything 17 U.S.C. § 512(c)(3) requires:
- your physical or electronic signature;
- identification of the copyrighted work you claim was infringed;
- identification of the material you claim is infringing, with enough detail for us to locate it (a URL);
- your address, telephone number, and email;
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-notice. If we remove your material and you believe it was a mistake or misidentification, you may send a counter-notice meeting the requirements of 17 U.S.C. § 512(g)(3), including your consent to the jurisdiction of the federal court for your district and your consent to accept service from the complaining party. We may restore the material in 10–14 business days unless the complaining party notifies us they have filed suit.
Misrepresentation. Knowingly and materially misrepresenting that material is infringing — or that it was removed by mistake — creates liability for damages under 17 U.S.C. § 512(f).
Repeat infringers. We terminate the accounts of repeat infringers in appropriate circumstances.
14. Our content
Excluding Your Content and third-party content, the Service — its articles, design, logos, name, code, and the compiled directories — belongs to Duck Friends and is protected by copyright and trademark law. You may read, link to, and quote it reasonably. You may not copy, republish, or build a competing directory from it. See the anti-scraping rule in Section 5.

15. Paid enhanced listings
Member accounts are free. Reading, posting, replying, keeping duck profiles, using the classifieds, and being listed in any directory cost nothing, and there is no paid membership tier.
The one paid thing on the Service is an enhanced listing for a veterinary practice. This section applies only if you buy one.
What it is. A recurring subscription that adds features to your directory listing: a photo gallery, booking link and promo banner; an "accepting new patients" badge; a Featured label with priority placement (see below); a clinic-account badge on your forum posts; members' messages delivered to your inbox; and basic view-and-click statistics. The current price, billing period, and included features are shown at checkout and on the Plans page.
Featured placement is paid placement, and it is labelled. Featured listings carry a "Featured" label and may appear ahead of unlabelled listings when members browse the directory or a city page. They are never placed ahead of a closer clinic when a member searches by location, and a Featured label does not mean we have vouched for the clinic's care.
What it is not. Paying us never buys editorial control over what members say about you — not removal, suppression, or reordering of forum posts today, and not of reviews if reviews ever launch. See Sections 6.2 and 6.4. It also does not make your listing "verified" in any sense beyond Section 6.5. The clinic-account badge on forum posts means only that the author manages a clinic listing on Duck Friends; it is not a statement about anyone's veterinary credentials, and nothing posted under it is veterinary advice (Section 9).
Billing and auto-renewal.
- Payments are processed by Stripe. We never receive or store your full card number.
- When you are charged. You can save a card while you claim your listing. Saving it charges nothing; we charge it only after your claim is verified. If your claim is rejected, the saved card is deleted and never charged.
- Your subscription renews automatically each billing period, at the then-current price, until you cancel. You give express affirmative consent to that automatic renewal by ticking a separate box where you save your card, apart from your agreement to these Terms. We keep a record of that consent (the date and time, the text you agreed to, and your IP address and browser) for at least three years, or one year after your subscription ends if that is longer.
- When your subscription starts we email you a confirmation with the price, the renewal terms, and how to cancel.
- We will send the renewal reminders and price-change notices required by the automatic-renewal law of your state, to the email on your account.
- You can cancel at any time, online, from your listing's billing settings, without calling or emailing anyone. Cancellation stops future charges; your enhanced features remain active through the end of the period you already paid for.
- We do not refund partial billing periods. If we materially reduce what an enhanced listing includes, or if we get the billing wrong, contact us and we will make it right.
- Prices exclude any applicable taxes. We may change prices with at least 30 days' notice before the change applies to your next renewal; if you don't want the new price, cancel before then.
- If a payment fails, we may retry it and may suspend the enhanced features until it clears. Your free basic listing stays.
Chargebacks. Talk to us before disputing a charge with your bank — we would rather refund a genuine mistake than fight it. We may suspend an account with an unresolved chargeback.
16. Moderation, suspension, and termination
We may warn, suspend (for a set period), or permanently ban an account, and remove or hide any content, when we judge that these Terms or the Community Guidelines have been broken — or when we judge it necessary to protect the community, a third party, or us. We record a reason for every such action.
A suspension or ban blocks you from signing in and from posting anywhere on the Service, including from an already-signed-in session.
We usually give notice and a reason, but we may act without prior notice where the situation warrants. To appeal, email [email protected]. We aim to answer appeals but we are a small operation and we do not guarantee a response or a reversal.
We may also discontinue the Service, in whole or in part, at any time. If we shut down entirely, we will give reasonable advance notice and a way to export your content where practical.
17. Deleting your account
You can delete your account at any time. When you do:
- Your profile, duck profiles, and photos are removed from public view and deleted.
- Forum posts and replies may remain, disassociated from your account, because deleting them would break conversations other members participated in. Tell us at [email protected] if you need specific posts removed and we will consider it.
- Messages remain visible to the other participant in the conversation.
- We retain moderation records, reports, and admin action logs where we need them for safety and legal purposes, and we retain backups for a reasonable period.

18. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, non-infringement, and any warranty arising from course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, or error-free; that content on it is accurate, complete, current, or safe to act on; that directory information is correct; or that any member, sitter, veterinary practice, rescue, or charity is who they say they are or is fit for any purpose.
We are not responsible for the conduct of any user, whether online or offline, and we have no duty to monitor, investigate, or police interactions between members.
Some states do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
19. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DUCK FRIENDS AND ITS OWNER, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR ANIMALS, ARISING OUT OF OR RELATING TO THE SERVICE — whether based in contract, tort, negligence, strict liability, or any other theory, and whether or not we were advised of the possibility.
OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (b) ONE HUNDRED US DOLLARS ($100).
This applies in particular to: harm arising from any in-person meeting, sitting arrangement, or transaction between members (Section 7); harm to an animal arising from information on the Service or from a veterinary practice found through it (Sections 6 and 9); and any decision you make about a covenant, code, or legal dispute (Section 8).
Nothing here limits liability that cannot be limited under applicable law, including for our own fraud, gross negligence, or willful misconduct where the law so provides. Some states do not allow certain limitations, so parts of this section may not apply to you.
20. Indemnification
You will defend, indemnify, and hold harmless Duck Friends and its owner, contractors, and agents from any claim, demand, loss, liability, damage, cost, or expense (including reasonable attorneys' fees) arising out of: Your Content; your use of the Service; your breach of these Terms; your violation of any law or of any third party's rights; or any interaction, arrangement, or dispute between you and another member — including any defamation claim brought over something you posted.
We may assume the exclusive defense of any matter subject to indemnification by you, at your expense, and you will cooperate with it.
21. Disputes, governing law, and venue
Talk to us first. Before filing anything, email [email protected] with a description of the dispute and what you want. We will try in good faith to resolve it within 30 days. Most things are fixable this way and we would rather fix them.
Governing law. These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules.
Venue. You and we agree to the exclusive jurisdiction and venue of the state and federal courts located in Washington County, Oregon — except that either of us may bring an individual claim in small claims court where it qualifies.
No class actions. To the fullest extent permitted by law, you and we each agree to bring claims only in an individual capacity, and not as a plaintiff or class member in any class, collective, consolidated, or representative action. If this waiver is held unenforceable as to a particular claim, that claim proceeds in court, but this waiver remains in force for all other claims.
Jury trial waiver. To the fullest extent permitted by law, you and we each waive any right to a jury trial.
Time limit. Any claim arising out of the Service must be filed within one year after it arises, or it is permanently barred, except where a longer period is required by law.
This draft uses courts + class waiver rather than mandatory arbitration. Rationale in
specs/09-legal/legal-review-notes.md§5 — for a free, solo-run site, the AAA consumer-arbitration filing fees fall almost entirely on the business, which makes arbitration a worse deal than court for us. Counsel may disagree.
22. General
Entire agreement. These Terms and the Privacy Policy are the whole agreement between you and us about the Service, and supersede anything said before.
Severability. If any provision is held unenforceable, it is modified to the minimum extent necessary or struck, and the rest stays in force.
No waiver. Our not enforcing a provision is not a waiver of it.
Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
Survival. Sections 4 (license), 7 (release), 13, 14, 17, 18, 19, 20, 21, and 22 survive termination.
Force majeure. We are not liable for failures caused by events beyond our reasonable control.
No third-party beneficiaries.
